Membership Application and Indemnification 

Purpose of Full Throttle Endurance Racing, Inc.


 

Full Throttle Endurance (the “Club”) is a Delaware corporation. As stated in the its adopted bylaws, the Club is organized and operated to promote triathlon and cycling throughout the United States. Specifically:

 

• All Club rides are designed to promote the enjoyment of triathlon and cycling in a friendly group atmosphere

 

• The Club is dedicated to introducing triathlon/cycling to people through the education and development of essential bicycling skills, which promote road safety and encourage enjoyment of the sport

 

• The Club encourages those who race at any competitive level to achieve their personal

best through advanced training and race participation as a team

 

• The Club supports and encourages family participation in recreational bicycling for the

promotion of physical fitness and development

 

• The Club provides opportunities to participate in a broad range of triathlon and cycling events and related activities at the local, national and international level

 

• The Club supports USA Triathlon and Cycling, Inc. and its affiliated organizations through paid membership and participation in sponsored events

 

• The Club supports the development of amateur racing throughout the United States

 

Amateur Team Mission Statement

As part of its activities, the Club has established local and regional racing

teams. In addition to their other purposes set forth below, these teams are

created to promote a positive image for the Full Throttle Nation and the Club’s other sponsors. The Club offers members opportunities to experience interpersonal growth, social development, improve physical and mental health and develop a lifetime skill for a healthier lifestyle. Through competition, the Club provides an environment for social interaction and team building, all while providing a marketing base for the companies that underwrite and sponsor the team(s).

Rules and Regulations

• All amateur riders on any Full Throttle Endurance Amateur team will be required to execute a form of the attached application and indemnification, and agree to abide by these Rules and Regulations.

 

• All amateur riders on any Full Throttle Endurance Racing Amateur team will be required to pay annual Club dues as fixed by the Club’s Executive Board. (updated information on website)

 

• The Full Throttle Endurance Racing Club is registered as sponsored with the United States Triathlon and USA Cycling, Inc., and is subject to their Rules, Bylaws and

Policies.

 

• All amateur riders on the Full Throttle Endurance Racing Amateur team(s) will be required to be licensed under the USA Triathlon, Inc. (“USAT”) organization. These licenses will need to be in good standing in order to ride for Full Throttle Endurance. Riders need to apply for the license under the club name “Full Throttle Endurance Inc.,” These licenses can be obtained directly from USAT’s website – www.usatriathlon.org.

 

• All riders must obey all rules and regulations as published in the USCF Road and Track

Rulebook. Copies of the Rulebook may be downloaded from the USAC website at

www.usacycling.org. Members may request a copy by sending a self-addressed mailing

label and a note that says “Rulebook” to the following address:

• All riders must behave in a manner appropriate to the Club and the sponsors they

represent (see USAC Rule 1O1). This means proper sportsmanship at all times (both

before, during and after an event or training ride). Any violations of this rule could mean

disciplinary action to the regional team (i.e., loss of sponsorship funds or termination of

the regional team). The Club and each regional team will honor any disciplinary action,

including but not limited to suspensions, taken against any rider(s) by USAC and its

associations, the United States Olympic Committee (“USAC”) or the Union Cycliste

Internationale (“UCI”), provided that due process was provided in imposing the

discipline.

 

• Riders shall not discriminate against or harass any club member, sponsor representative,

supplier, rider, official or spectator based upon race, sex, religion, disability, or

affectional preference.

• Each regional team will be required to designate one (1) team manager who will be

responsible for organizing regional team members that will represent the Club in a

professional manner. Riders violating these Rules and Regulations will be subject to

disciplinary action, including suspension or termination. Any disciplinary action by the

team manager will be honored by the Club as long at it is warranted under these Rules

and Regulations. Should action be taken against a rider, the team manager will notify the

Regional Team Director or Scott Berlinger (Club President) prior to any suspension or termination.

 

• All equipment, including but not limited to bicycles, wheels, components, bags, racks

provided by the Club to any rider(s) without cost, will at all times remain the sole

property of the Club. At the end of the racing season or when the rider ceases to be a

member of the Club for any reason, whichever is sooner, the rider will be responsible to

return such equipment to the Club in good working order, subject to reasonable and

expected wear and tear. This excludes tires and perishable items (energy bars, beverages,

water bottles). While riders will not be responsible for damage occurring during races or

training as a result of a mishap, they will be responsible to loss or damage caused by the

rider’s own negligence.

 

• Any rider suspended by USAC for violation of USAC Rule 1O2 or 1O5(c), or for

similar conduct proscribed by any other sanctioning athletic body with jurisdiction over

bicycle racing in the rider’s home state, will be subject to immediate termination from

Full Throttle Endurance Racing Amateur team.

 

• The Club’s riders are subject to the United States Anti-Doping Agency (“USADA”)

protocol for Olympic movement testing (“USADA protocol”). The USADA protocol is

adopted and incorporated herein by reference. The USADA protocol and the official and

most updated list of the “Prohibited Classes of Substances and Prohibited Methods” may

be found on USADA’s website at www.usantidoping.org. Any rider found by

USADA to have violated the USADA protocol will be subject to immediate

termination and exclusion from any Full Throttle Endurance Racing Amateur team.

 

• All riders must wear proper Full Throttle Endurance Racing uniforms at all times (unless provided written approval from the club officers) while in any race or competition. These uniforms must be clean (see USAC Rule 1L1). Category 1&2 riders who are on the team must wear identifiably similar uniforms when competing in a massed start race (see USAC Rule 1L3). No rider riding for Full Throttle Endurance Racing as a member in any USAC category, will be allowed to wear another club or team jersey during the year.

 

ALL RIDERS WILL BE REQUIRED TO WEAR HELMETS WHICH COMPLY WITH USAC POLICIES (SEE USAC POLICY I, SECTIONS 1 AND 2) AT ALL TIMES WHEN RACING OR TRAINING WHETHER THE RACE OR TRAINING RIDE IS SANCTIONED BY USAC OR NOT.

ALL RIDERS RIDE AT THEIR OWN RISK. NEITHER THE FULL THROTTLE ENDURANCE RACING AMATEUR TEAMS, THE CLUB, ITS MEMBERS, DIRECTORS, OFFICIALS AND ATTORNEYS ASSUME ANY LIABILITY TO THE REGIONAL TEAMS OR ANY RIDERS RIDING AS MEMBERS OF ANY REGIONAL TEAM. CYCLING IS AN INHERENTLY DANGEROUS SPORT WHERE SERIOUS INJURY AND DEATH CAN AND DOES OCCUR. THUS, ALL TEAM MEMBERS ASSUME THEIR OWN RISK WHEN RIDING FOR ANY REGIONAL TEAM. IT IS RECOMMENDED THAT ALL RIDERS HAVE SOME FORM OF MEDICAL INSURANCE BEFORE RACING ON THE TEAM. THE CLUB DOES NOT PROVIDE ANY MEDICAL OR ACCIDENT INSURANCE TO ITS MEMBERS.

 

• All riders will be given a copy of these rules and regulations and are required to sign at

the bottom of the statement. Two (2) copies should be made. One to be:

 

1- retained by signed rider;

2- sent to Full Throttle Endurance Racing Club’s Membership Director at the following address:

• All rider applicants must pay their annual dues at the time they hand in or mail this

application or show sufficient proof of payment. Benefits of club membership can be

found on the team website.

 

• No team may sponsor or promote a race or non-competitive event that is not sanctioned

by USAC and/or USAT without the written consent of the Club’s Executive Board. The Club’s Executive Board will consider the insurance provided in connection with any such event as a primary factor in determining whether to issue an approval. All approvals provided will be conditional upon the regional team providing the Club with a Certificate of Insurance naming “Full Throttle Endurance, Inc., its sponsors, directors, officers, members, attorneys and employees” as insureds. Documentation must be provided confirming insurance coverage for the event at least equal to that provided by USAC and/or USAT for such events.

 

• These Rules and Regulations will be posted on the Club’s website at www.fullthrottleendurance.com. They are subject to periodic change upon the decision of the Club’s Executive Board. Riders will be subject to any such changes once notice of the

changes is posted on the Club’s website.

I hereby apply for membership in Full Throttle Endurance Racing, Inc. (the “Club”) and in the above named amateur regional racing team. I acknowledge that by signing this document, I am releasing Full Throttle Endurance Inc., its sponsors, members, directors, officers, attorneys and employees from liability of any kind. I ACKNOWLEDGE THAT CYCLING IS AN INHERENTLY DANGEROUS SPORT WHERE SERIOUS INJURY AND DEATH CAN AND DOES OCCUR. I understand and agree that I will participate in all Club and regional team activities at my own risk. I further understand and agree that the Club is a corporation that provides cycling activities for its members and for the advancement of the sport, which will be a direct benefit to me.

 

Therefore, on behalf of myself, my heirs, successors and assigns, and personal representatives, I HEREBY WAIVE, RELEASE, HOLD HARMLESS, DISCHARGE, INDEMNIFY AND PROMISE NOT TO SUE FULL THROTTLE ENDURANCE RACING, INC., its sponsors, members, directors, officers, attorneys and employees (collectively the “Released Parties”) from any and all rights and claims including those arising from the Released Parties’ own negligence, which I have or which I may hereafter accrue from any and all damages sustained by me of any kind directly or indirectly in connection with, or arising out of, my participation in any races, training/club rides or other activities run, sponsored, promoted or encouraged by the Club and/or regional team or travel to or return from such activities. I represent that, based upon a recent physical examination by a licensed medical provider, to the best of my knowledge I have no medical or physical condition that would affect my ability to participate in bicycle racing or any Club/team event or that my participation would

endanger my health. I acknowledge that I have been advised to read this entire document and the attached Rules and Regulations carefully and that they have legal consequences. I represent that I have read both documents carefully, that I agree to abide by the promises I am making in this application, and that I am knowingly and voluntarily signing this application. I understand that the Club is relying upon my promises in this application and would not grant me membership in the Club or on the regional team without my promises. If accepted as a member of the Club, I agree to abide by all the Club’s Rules, Regulations and Bylaws.
